Affilo: terms for creators and designers

Draft, 6 November 2026. Written in-house; not yet reviewed by a solicitor. The Affilo company is being incorporated in England and Wales and will be named here once it is.

These terms are between you (a creator who posts about products, or a designer who makes static ads; together “makers”) and Affilo (the company, being incorporated in England and Wales; “Affilo”, “we”). They cover the products you promote through Affilo, the work you make for brands, and how you are paid.

1. What Affilo is

1.1Affilo is a marketplace. Brands list products with a commission rate. You take a product, post about it on your own accounts with the link, code or tag we give you, and earn a commission on every sale that comes through them. You can also submit a video or static to a brand’s advertising programme, which the brand runs as its own ad, and earn on the sales that brings.

1.2You work for yourself. Nothing in these terms makes you our employee, worker, partner or agent, or the brand’s. You are free to work with any brand, on any platform, at any time. Affilo asks for no exclusivity and has no non-circumvention clause for makers. The one exception is a deal you choose: a brand may offer you a higher, exclusive rate in return for taking no rival product in its category on Affilo for a fixed term (section 3.5).

2. Your account

2.1You must be 18 or over and able to make a binding agreement. Every maker is reviewed by a person on our team before they can take products; we may decline an application without giving a reason.

2.2Keep your details true and up to date. One account per person.

2.3To be paid you must finish identity and bank checks with our payment provider (Stripe). Until then, what you earn is kept for you (section 6.5).

2.4Connecting Instagram and Facebook is required to join as a creator. You connect your Instagram professional account through Instagram or Facebook Login when you sign up, and keep it connected while you use Affilo. Switching to a professional account is free. Without a connection you can’t take products, ask for samples or send work to brands. Designers don’t need to connect. Section 12 says what we read and how we use it.

3. Taking a product

3.1Each product shows its commission rate, whether a sample is offered, and the brand’s rulebook (the claims it allows and bans, and the disclosure wording it requires). Some products are open to every maker; some are by invitation, at the rate the invitation shows.

3.2When you take a product you get a tracked link, a personal discount code, and the product ready to tag where tags are available. Your rate is fixed when you take it. A brand can change a product’s rate for makers who take it afterwards, not for you.

3.3Your personal code is yours. Don’t publish it on coupon sites or anywhere a stranger could copy it; we pause and reissue a code that leaks, and sales through a leaked code before we pause it don’t pay.

3.4A sample is the brand’s property until you’ve posted about it. If you request a sample and don’t post within 21 days, the brand can decline your future sample requests.

3.5Exclusive deals. A brand may offer you an exclusive rate: higher than its invited rate, for a term of 30, 90 or 180 days, during which you agree not to take rival products in that category on Affilo. You accept or decline each offer; nothing happens unless you accept. While it runs, rival products in that category are hidden from you and you aren’t recommended to those brands. It ends on the date, or earlier if the brand stops paying, and you can then take anything. It never restricts what you do off Affilo.

4. Posting, and work for a brand’s ads

4.1Follow the brand’s rulebook. Say only true things about your own experience, and only claims about the product that the brand has approved.

4.2Disclose. A link that pays you is a material connection. Every post, Story, Live and video that carries your link, code or tag must say so: “#ad” or the platform’s paid-partnership label, where the viewer sees it before the link. This is the law in the UK and the US, and the platform’s label alone may not be enough. Posts without it are flagged to the brand and can be refused.

4.3You promise that everything you post or submit is your own original work, or you hold the rights to everything in it; it includes nobody else’s face, voice, clip or photo without their written permission; it names no illness or medical condition unless the brand approved the exact words; and it follows the CAP Code, the CMA’s guidance on endorsements, and the law where it is seen.

4.4Scripts. Where a brand asks for a script or caption before you film, send it; a person at the brand approves or edits it, usually within a day. Lines that touch a rule are highlighted for both of you. Nothing in the highlighter rejects anything, and nothing you check is stored against you.

4.5Boosting. A brand may ask to run your post as a partnership ad from its own account. You choose, post by post, and you see the boosted rate before you say yes. If you say yes, you earn the boosted rate on every sale the ad brings, and the brand may run the ad for as long as it pays commission on it. You can withdraw the partnership permission after the ad stops.

4.6Submitting to an ad programme. You can make a video or static for a brand’s ad programme without posting it. If the brand approves it, it has 30 days to run it; if it doesn’t, it pays you an unused fee (£25 for a video, £15 for a static, split like commission if you shared the work), once, and you still earn if it runs later. A brand can release approved work within 7 days of approving it at no cost, and then can’t run it. Declined work earns nothing and isn’t held against you.

5. Rights in your work

5.1You keep the copyright in what you post and make.

5.2By taking a product you give the brand permission to show your post, with your name or handle, in its results and on Affilo. You give it no other rights in a post you haven’t agreed to boost.

5.3When you agree to a boost, or a brand approves work you submitted, you give that brand a licence to use, edit, crop, caption, translate and run it in its advertising and on its own channels, worldwide, for as long as it pays commission on it, plus 90 days to take ads down. New versions (hooks, cut-downs) pay you the same rate. You can’t object to a new version unless it changes the meaning of what you said or puts words in your mouth.

5.4You give Affilo permission to show your work and name in our own marketing, unless you tell us not to.

6. How you’re paid

6.1What you earn. Your rate, on the order’s value after discounts and excluding VAT and shipping, on every order credited to you. New customer or returning, first order or tenth, it is the same.

6.2Which orders are yours. An order is credited to the maker whose link, tag or ad was tapped most recently before it, within the brand’s click window (7 days unless the brand sets another). If no link was tapped in the window, an order with your personal code on it is yours. One order is only ever credited to one maker, and we decide from the tracking data. Where the data is missing we can’t credit an order. Every order behind every payment is on your statement.

6.3Shared work. Where work is made by more than one maker (a static designed from a creator’s post, say), commission is split by the shares shown on the work before you agreed to it.

6.4When you’re paid. Every week. We total what you’ve earned that the brand has paid us for, take off any adjustments (section 7), and send it to your account through Stripe. There is no waiting period for refunds.

6.5Minimum. If your weekly total is under £10 (or the same in your currency), it carries to the next week. It never expires while your account is open. If your account is closed, we pay whatever is owed on the next run.

6.6You’re paid when the brand pays. We pay you from the money the brand pays for your commission. If a brand doesn’t pay, we chase it; your commission stays owed to you and is paid as soon as the brand pays. We act as your limited payment collection agent: when a brand pays us your commission, that counts as the brand paying you.

6.7Currency and fees. Commission is earned in the brand’s currency and converted by Stripe when paid out to you. Affilo charges makers nothing, ever. Your bank or Stripe may charge for currency conversion or for payouts to some countries; we’ll show you any such cost before you set up your account.

6.8Agencies. Some brands have an agency run their programme. The brand pays the agency’s fee on top of your commission; it never comes out of what you earn.

6.9Tax. You’re responsible for your own tax and National Insurance (or the equivalent where you live), and for charging VAT if you’re registered. We may have to report your earnings to tax authorities where the law requires it.

7. Refunds and adjustments

7.1If an order you earned on is refunded, cancelled or charged back, we take back the commission on the refunded part from your next payout. We don’t take money back for any other reason, except fraud (section 8).

7.2If adjustments are larger than a week’s earnings, the balance carries forward and comes off future earnings. We won’t ask you to pay it back from your own pocket unless it came from fraud.

8. Fraud and abuse

8.1You must not buy through your own link or code to earn on it, pay or encourage people to order and refund, use bots or bought traffic, publish your code on coupon sites, bid on a brand’s name in search ads, or do anything else to create orders that wouldn’t otherwise happen.

8.2If we reasonably believe you have, we can hold the commission concerned while we look into it, cancel commission earned that way, take back commission already paid for it, and close your account. We’ll tell you what we found and give you 14 days to respond before we cancel anything. New accounts may have their first payout held for up to 14 days while we check it.

9. Leaving

9.1You can close your account at any time, from Me on the web or in the app; the steps are at affilo.app/privacy#delete. Links and codes stop working; what you’ve earned is paid on the next run.

9.2We can close your account with 30 days’ notice for any reason, or straight away for a serious breach.

9.3Disconnecting Instagram and Facebook ends your use of the marketplace until you connect again (section 2.4). Your links, earnings and payouts are not affected.

10. Questions about a payment

Tell us within 90 days of a payout if you think it’s wrong. We’ll reply within 14 days with the orders behind it.

11. Liability

11.1Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow to be limited.

11.2Otherwise, our total liability to you in any 12 months is limited to the commission paid or owed to you in that period, and we’re not liable for loss of profit, opportunity or reputation.

11.3You’re responsible for claims arising from your breach of section 4 (for example using music you didn’t have rights to, or an undisclosed ad).

12. Your data

12.1We use your details to run your account, pay you, meet legal duties and stop fraud, as set out in our privacy notice at affilo.app/privacy. We share with brands only what they need: your name or handle, your posts and work for them, and your results on their products.

12.2What we read from Meta. While you’re connected we read, daily and through Meta’s official tools, what Meta reports about your own professional account: followers and growth, reach and views, engagement by format, Story completion, your recent posts’ results, and Meta’s audience breakdown in aggregate (age bands, gender, top countries and cities). Never your followers one by one, and never your messages.

12.3Lawful basis. We process it because it is part of this contract, and in our legitimate interest in running a fair marketplace. It is not based on consent, so there is no setting to switch it off while you stay; you can disconnect or close your account at any time.

12.4What we use it for. Vetting your application, matching and ranking you for brands, suggesting rates and expected sales, spotting fraud, and understanding the market. We never sell it or pass it on.

12.5What brands see. Our verdicts only: Verified, how well your audience matches their customers, an expected sales range, a trust signal and bands (such as “10k–25k followers”), with your sales on Affilo. Never your raw numbers, follower curves or audience breakdown. A media kit shows only the stats you choose to publish.

12.6Deletion. When you disconnect or close your account, we delete everything we got from Meta within 24 hours. If you remove Affilo in your Instagram or Facebook settings, Meta tells us and we do the same; you can check its status at affilo.app/api/meta/deletion?code= followed by the code Meta gives you. Your sales records stay, as the law asks us to keep payment records.

12.7The Affilo app. If you use the app, we keep a session (only as a one-way hash), the name the app gives your device and when it was last used, and, if you allow notifications, your device’s push token, stored encrypted. Signing out of the app deletes its session and push token.

13. Changes

We may update these terms. We’ll give you 30 days’ notice of any change that affects how you’re paid, and no change reduces the rate on a product you’ve already taken or work already approved.

14. Law

These terms are governed by the law of England and Wales. Courts there decide disputes, but if you live elsewhere you keep any rights your local law gives you.
